Selling inherited land in Kentucky
You can sell inherited land in Kentucky once the right person has authority to sign the deed. Whether that takes full probate depends on Kentucky's rules, the will, and the size of the estate.
Request an offerKentucky's small estate rules
In Kentucky, the small estate process generally does not transfer land, so heirs of vacant land usually need probate or another court step first.
The threshold: $30,000 exemption for personal property or money on hand or in a bank (KRS 391.030). It is set apart by District Court to a surviving spouse or children. Under KRS 395.455 (as amended effective July 15, 2026) the court may dispense with administration. The court may do so when that exemption plus paid preferred claims equals or exceeds the distributable assets.
The exemption covers personal property and money only. Transferring land to heirs needs probate or another title process.
Law: KRS 391.030(1)(c) and 395.455. Confirm current figures with the probate court.
Steps to sell inherited land in Kentucky
- Find the will, if there is one, and the deed or tax bill showing the parcel.
- Ask the probate court or an attorney which path applies: full probate, a small estate process, or another filing.
- Get written proof of who can sign, such as letters from the court. The title company will ask for it.
- If several heirs inherited the land, agree on the sale and the split in writing. See selling land owned by several heirs.
- Ask for a cash offer and compare it with a listing. Taxes and loans are paid from the sale at closing.
Taxes when you sell
Inherited land usually gets a stepped-up basis: its value on the date of death. If you sell close to that value, the taxable gain may be small. Our capital gains guide explains it. Ask a CPA about your numbers.
Kentucky land at a glance
- Average farm real estate value: $5,600 per acre (2026, USDA).
- Average property tax on farmland: about $13.62 per acre per year (2022 Census of Agriculture).
- Transfer tax: $0.50 for each $500 of value or fraction of $500 (0.1%), collected by the county clerk before the deed is recorded.
- Seller disclosure: KRS 324.360 covers only sales of single-family residential dwellings when a licensee is paid, so vacant land needs no state seller disclosure form.
