Tennessee charges a state transfer tax: realty transfer (recordation) tax of $0.37 per $100 of purchase price, generally on the greater of consideration paid or property value. Tennessee's residential disclosure form is not required for vacant land, because the disclosure act covers only one to four dwelling units (Tenn. Code Ann. 66-5-201).

How selling your Tennessee land works

  1. Tell us about your land. Tell us a little about your land. We'll need the county, state and parcel number.
  2. Get your offer. We research the parcel: access, zoning, taxes and recent sales nearby. Then we send you a written offer.
  3. Sign the purchase agreement. Sign the purchase agreement by email, or we mail it to you. It names the price and the closing company.
  4. Schedule closing. We work with a local closing company to manage the entire closing process at our expense.
  5. Get paid. When the closing paperwork is ready, you sign the deed and receive the funds from the closing company directly.

Tennessee land selling questions

Is there a transfer tax when I sell land in Tennessee?

Yes. Tennessee's realty transfer tax is 37 cents per $100, generally based on the price or the property's value, whichever is greater. The county register of deeds collects it, and the deed cannot be recorded until it is paid. A separate mortgage tax of 11.5 cents per $100 applies when a mortgage or deed of trust is recorded. The first $2,000 of that debt is exempt. Ask your county register of deeds or title company about exemptions. Source: Tennessee Department of Revenue, Recordation Tax rates (T.C.A. 67-4-409).

What happens if I don't pay property taxes on my Tennessee land?

Interest is added, and the county can sue to sell the land. Unpaid property taxes add 1.5% interest on March 1 after the due date, and 1.5% more on the first of each month after that. The county's delinquent tax attorney then files a court suit to enforce the tax lien. Filing the suit generally adds a 10% penalty on the base taxes, plus court costs and attorney fees. The court can then order the land sold at a tax sale. Source: T.C.A. 67-5-2010, 67-5-2405, 67-5-2410 and 67-5-2501.

Can I get my Tennessee land back after a tax sale?

Yes, if you redeem within the period that starts when the court confirms the sale. If inspections show the property is vacant, or that vacant land is abandoned, the period is only 30 days. Overgrown or dead vegetation is one of the signs of abandonment the law lists. Otherwise, for orders on or after July 1, 2026, it is 1 year if taxes were 3 years delinquent or less, 90 days if longer. To redeem, you file a motion and pay the taxes, penalty, interest, court costs and 12% yearly interest on the buyer's price. Ask the clerk of the court that sold the parcel for your deadline. Do I need a disclosure statement to sell vacant land in Tennessee?

Not the state's residential disclosure form. Tennessee's Residential Property Disclosure Act applies to residential property with one to four dwelling units. Vacant land with no dwelling falls outside it. The same law also lists items a seller must disclose, such as a known sinkhole, a known exterior injection well and known percolation test results. Ask a Tennessee real estate attorney whether those items apply to your parcel. Source: T.C.A. 66-5-201 and 66-5-212.

Will selling my greenbelt land in Tennessee trigger rollback taxes?

Not if the buyer keeps the land in greenbelt. Greenbelt status does not carry over to a new owner on its own. The new owner must file its own application, or the land can be disqualified and rollback taxes become due. Rollback taxes equal the tax savings for the past 3 years for agricultural and forest land, or 5 years for open space land. Developing land under a recorded subdivision plat also triggers rollback on the phases being developed. Ask your county assessor of property before you sign. Can I sell my Tennessee land if I live in another state?

Yes. Liberty Acres buys land anywhere in the US, so you do not need to live in Tennessee to sell to us. We close through a title company and pay back taxes and all closing costs. There are no agents and no commissions.
