How selling your Georgia land works

  1. Tell us about your land. Tell us a little about your land. We'll need the county, state and parcel number.
  2. Get your offer. We research the parcel: access, zoning, taxes and recent sales nearby. Then we send you a written offer.
  3. Sign the purchase agreement. Sign the purchase agreement by email, or we mail it to you. It names the price and the closing company.
  4. Schedule closing. We work with a local closing company to manage the entire closing process at our expense.
  5. Get paid. When the closing paperwork is ready, you sign the deed and receive the funds from the closing company directly.

Georgia land selling questions

Is there a transfer tax when I sell land in Georgia?

Yes. Georgia's real estate transfer tax is $1 for the first $1,000 of the sale price, or fraction of $1,000. It adds 10 cents for each additional $100, or fraction of $100. The tax must be paid before the deed can be recorded with the clerk of the superior court. Ask the clerk in your county about exemptions. What happens if I don't pay property taxes on my Georgia land?

Interest and penalties are added to the bill. Interest accrues monthly, based on the current year's bank prime rate plus 3%. A 5% penalty is added if any part of the bill is unpaid 120 days after the due date. Another 5% is added every 120 days after that, up to 20% in total. Your county tax commissioner can tell you what your parcel owes. Source: Clayton County Tax Commissioner, Penalties.

Can Georgia sell my land for unpaid property taxes?

Yes, at a tax sale. After a standard tax sale, you can redeem the land for at least 12 months. The price is the tax sale price plus later taxes, special assessments and some costs, plus a premium. The premium is 20% for the first year or part of a year, and 10% for each added year or part. After 12 months, the buyer can start to end your right to redeem by serving notice. Some counties use a court tax foreclosure instead, where only the owner can redeem, and only for 60 days after the sale. Your county tax commissioner can tell you which process applies to your parcel. Source: O.C.G.A. 48-4-40, 48-4-42 and 48-4-81.

Will selling my Georgia land in a conservation use (CUVA) covenant trigger a penalty?

Not if a qualified buyer continues the covenant. Georgia law lets a buyer who qualifies continue the original covenant for the rest of its term, and then no breach occurs. If the covenant is breached, the penalty is twice the tax savings for each full or partial year the covenant ran. The penalty applies to the entire tract and is a lien on the property. Ask your county board of tax assessors how a sale affects your covenant. Source: O.C.G.A. 48-5-7.4(i), (l) and (m).

Does my Georgia conservation use (CUVA) covenant transfer to the buyer?

It can, if the buyer qualifies and applies. The buyer must apply to continue the covenant by the last day for filing tax returns in the year after the sale. Approved covenant applications are filed in the real property records of the superior court clerk. If an application was not recorded there, a buyer is not bound by the covenant or any penalty for its breach. Your county board of tax assessors can confirm your covenant's status. Source: O.C.G.A. 48-5-7.4(i) and (j).

Can I sell my Georgia land if I live in another state?

Yes. You do not need to live in Georgia to sell Georgia land to us. Liberty Acres buys land anywhere in the US and closes through a title company. We pay back taxes and all closing costs, and there are no agents and no commissions.
