Selling inherited land in Nevada
You can sell inherited land in Nevada once the right person has authority to sign the deed. Whether that takes full probate depends on Nevada's rules, the will, and the size of the estate.
Request an offerNevada's small estate rules
In Nevada, the simplified small estate process can be used for real estate in some cases.
The threshold: Set aside without administration by court order: estate value not over $150,000 (NRS 146.070). Affidavit transfer (NRS 146.080): $25,000 for most claimants, $150,000 for a surviving spouse, and only if the decedent left no real property.
The NRS 146.080 affidavit excludes real property. The NRS 146.070 court petition to set aside an estate of $150,000 or less is not limited to personal property. Land can therefore pass that way with a court order. Confirm with a Nevada attorney.
Law: NRS 146.070, 146.080. Confirm current figures with the probate court.
Steps to sell inherited land in Nevada
- Find the will, if there is one, and the deed or tax bill showing the parcel.
- Ask the probate court or an attorney which path applies: full probate, a small estate process, or another filing.
- Get written proof of who can sign, such as letters from the court. The title company will ask for it.
- If several heirs inherited the land, agree on the sale and the split in writing. See selling land owned by several heirs.
- Ask for a cash offer and compare it with a listing. Taxes and loans are paid from the sale at closing.
Taxes when you sell
Inherited land usually gets a stepped-up basis: its value on the date of death. If you sell close to that value, the taxable gain may be small. Our capital gains guide explains it. Ask a CPA about your numbers.
Nevada land at a glance
- Average farm real estate value: $1,230 per acre (2026, USDA).
- Average property tax on farmland: about $3.97 per acre per year (2022 Census of Agriculture).
- Transfer tax: Real property transfer tax of $1.95 per $500 of value (0.39%) in most counties, $2.05 (0.41%) in Washoe and Churchill, and $2.55 (0.51%) in Clark. The base is 65 cents under NRS 375.020 plus $1.30 under NRS 375.023, and Clark's NRS 375.020 rate is $1.25. Washoe and Churchill add a 10-cent local levy. The tax applies when the value exceeds $100.
- Seller disclosure: Nevada requires a recorded, written open range disclosure for any improved or unimproved lot next to open range (NRS 113.065). A seller must also disclose any private transfer fee obligation on the land (NRS 113.085). The general disclosure form covers only residential property, land with 1 to 4 dwelling units affixed, so it does not reach vacant land.
