Selling inherited land in New Hampshire

You can sell inherited land in New Hampshire once the right person has authority to sign the deed. Whether that takes full probate depends on New Hampshire's rules, the will, and the size of the estate.

New Hampshire's small estate rules

In New Hampshire, the small estate process generally does not transfer land, so heirs of vacant land usually need probate or another court step first.

The threshold: RSA 553:32 allows a waiver of administration (no inventory, bond, or accounting) in specified simple situations, with no stated dollar limit.

New Hampshire has no small estate affidavit for land, so an heir usually needs a probate appointment before selling. Waiver of administration (RSA 553:32) skips the inventory, bond and accounting. The administrator later files an affidavit of administration listing all real estate.

Law: RSA 553:32. Confirm current figures with the probate court.

Steps to sell inherited land in New Hampshire

  • Find the will, if there is one, and the deed or tax bill showing the parcel.
  • Ask the probate court or an attorney which path applies: full probate, a small estate process, or another filing.
  • Get written proof of who can sign, such as letters from the court. The title company will ask for it.
  • If several heirs inherited the land, agree on the sale and the split in writing. See selling land owned by several heirs.
  • Ask for a cash offer and compare it with a listing. Taxes and loans are paid from the sale at closing.

Taxes when you sell

Inherited land usually gets a stepped-up basis: its value on the date of death. If you sell close to that value, the taxable gain may be small. Our capital gains guide explains it. Ask a CPA about your numbers.

New Hampshire land at a glance

  • Average farm real estate value: $6,670 per acre (2026, USDA).
  • Average property tax on farmland: about $69.61 per acre per year (2022 Census of Agriculture).
  • Transfer tax: Real estate transfer tax of $0.75 per $100 of price, applied twice under RSA 78-B:4, so the total is $1.50 per $100 (1.5%). Where the price is $4,000 or less, the statute sets a minimum tax of $20.
  • Seller disclosure: New Hampshire requires a written seller disclosure for land used or proposed for a 1 to 4 family home, even with no building (RSA 477:4-d). It covers any private water and sewage systems, insulation, a federal flood hazard zone and a residential heating oil tank. If water, sewage or insulation information is not available, the seller must say so in writing. Any seller must also disclose known methamphetamine production on the property (RSA 477:4-g). The radon, arsenic, lead, PFAS and flood notice (RSA 477:4-a) and the RSA 477:4-c water and septic disclosure apply only where there is a building.
