Selling inherited land in New Jersey
You can sell inherited land in New Jersey once the right person has authority to sign the deed. Whether that takes full probate depends on New Jersey's rules, the will, and the size of the estate.
Request an offerNew Jersey's small estate rules
In New Jersey, the simplified small estate process can be used for real estate in some cases.
The threshold: $50,000 total real plus personal assets, intestate estate, surviving spouse/civil union/domestic partner only, by affidavit before the county Surrogate (first $10,000 free from debts).
With no will and total real and personal assets of $50,000 or less, a surviving spouse or partner can take them by Surrogate affidavit. With no spouse or partner, one heir can use a similar affidavit if assets are $20,000 or less and the other heirs consent in writing. A will or a larger estate needs probate or administration.
Law: N.J.S.A. 3B:10-3, 3B:10-4. Confirm current figures with the probate court.
Steps to sell inherited land in New Jersey
- Find the will, if there is one, and the deed or tax bill showing the parcel.
- Ask the probate court or an attorney which path applies: full probate, a small estate process, or another filing.
- Get written proof of who can sign, such as letters from the court. The title company will ask for it.
- If several heirs inherited the land, agree on the sale and the split in writing. See selling land owned by several heirs.
- Ask for a cash offer and compare it with a listing. Taxes and loans are paid from the sale at closing.
Taxes when you sell
Inherited land usually gets a stepped-up basis: its value on the date of death. If you sell close to that value, the taxable gain may be small. Our capital gains guide explains it. Ask a CPA about your numbers.
New Jersey land at a glance
- Average farm real estate value: $17,000 per acre (2026, USDA).
- Average property tax on farmland: about $108.52 per acre per year (2022 Census of Agriculture).
- Transfer tax: A graduated Realty Transfer Fee of $2.00 per $500 (0.4%) on the first $150,000, with higher rates on larger sales. For a sale of $350,000 or less, the rate is $3.35 per $500 from $150,000 to $200,000 and $3.90 per $500 above that. For a sale over $350,000, a higher table applies to the whole price, from $2.90 per $500 up to $6.05 per $500 over $1 million. The 1% to 3.5% Graduated Percent Fee on sales over $1 million does not apply to vacant land sold on its own.
- Seller disclosure: Every New Jersey seller of real property, including vacant land, must complete the Flood Risk Addendum of the state disclosure form. The seller states whether the land is in a FEMA Special or Moderate Risk Flood Hazard Area and any known flood risk. The buyer must get it before signing a purchase contract (N.J.S.A. 56:8-19.2). The rest of the state condition form is mandatory for residential sales.
