Selling inherited land in South Carolina

You can sell inherited land in South Carolina once the right person has authority to sign the deed. Whether that takes full probate depends on South Carolina's rules, the will, and the size of the estate.

South Carolina's small estate rules

In South Carolina, the small estate process generally does not transfer land, so heirs of vacant land usually need probate or another court step first.

The threshold: $45,000 (raised from $25,000 by 2025 Act No. 26, eff. May 8, 2025). Net probate estate, less liens and encumbrances. Affidavit may be used 30 days after death.

The affidavit under 62-3-1201 collects personal property only (tangible property, debts, securities). It does not transfer land. For estates of $45,000 or less, a personal representative can use summary administration under 62-3-1203 after appointment and creditor notice. The representative can then file a closing statement under 62-3-1204. Land still requires a probate proceeding.

Law: S.C. Code 62-3-1201, 62-3-1203, 62-3-1204. Confirm current figures with the probate court.

Steps to sell inherited land in South Carolina

  • Find the will, if there is one, and the deed or tax bill showing the parcel.
  • Ask the probate court or an attorney which path applies: full probate, a small estate process, or another filing.
  • Get written proof of who can sign, such as letters from the court. The title company will ask for it.
  • If several heirs inherited the land, agree on the sale and the split in writing. See selling land owned by several heirs.
  • Ask for a cash offer and compare it with a listing. Taxes and loans are paid from the sale at closing.

Taxes when you sell

Inherited land usually gets a stepped-up basis: its value on the date of death. If you sell close to that value, the taxable gain may be small. Our capital gains guide explains it. Ask a CPA about your numbers.

South Carolina land at a glance

  • Average farm real estate value: $4,900 per acre (2026, USDA).
  • Average property tax on farmland: about $12.86 per acre per year (2022 Census of Agriculture).
  • Transfer tax: Deed recording fee of $1.85 per $500 (or fractional part) of value: $1.30 state plus $0.55 county. Collected at deed recording, so functionally a transfer tax. State law bars new local transfer fees, but the Town of Hilton Head Island still charges 0.25% under an older ordinance (S.C. Code 6-1-70).
  • Seller disclosure: South Carolina's residential disclosure statement does not apply to a vacant lot with no dwelling, but beachfront land has its own required notice. The Residential Property Condition Disclosure Act covers only residential property with one to four dwelling units (S.C. Code 27-50-20). A sale contract for land seaward of the coastal setback or jurisdictional line must disclose those lines and the local erosion rate (S.C. Code 48-39-330).
