Michigan land selling questions

Is there a transfer tax when I sell land in Michigan?

Yes, Michigan's state real estate transfer tax is $3.75 for each $500 of value or fraction of $500, about 0.75%. County transfer tax adds 55 cents per $500, about 0.11%, so the total is about 0.86%. The state tax exempts some principal residence sales whose state equalized value is no higher than when the seller acquired them. That exemption needs a principal residence exemption on the property, so it seldom applies to vacant land. Ask your title company for the total on your sale. What happens if I don't pay property taxes on my Michigan land?

The land can be forfeited and foreclosed, and title passes to the county or state if you do not redeem in time. Unpaid taxes are returned to the county treasurer on March 1 of the next year, with a 4% administration fee and 1% interest a month. If they are still unpaid a year later, the land is forfeited on March 1, and a $175 fee and more interest are added. You can redeem until the March 31 after the court's foreclosure judgment, or within 21 days of it in a contested case. Your county treasurer can give you the payoff and your deadline. Do I get any money if Michigan forecloses on my land for back taxes?

Possibly, but only if you file a claim on time. Anyone with an interest in the land just before foreclosure can claim proceeds above the minimum bid, other costs and a 5% sale commission. By the July 1 after the foreclosure takes effect, give the foreclosing county or state a notarized notice on the Treasury form. Deliver it in person or send it by certified mail with a return receipt. Then file a motion in the circuit court between February 1 and May 15 after the sale. Older sales follow other rules, so ask your county treasurer or an attorney about your deadlines. Source: MCL 211.78t (added by 2020 PA 256 after Rafaeli v Oakland County).

Do I need a seller disclosure statement to sell vacant land in Michigan?

Not the state's seller disclosure statement, which applies only to real estate with 1 to 4 residential dwelling units. The deed for unplatted land must state how many land divisions pass to the buyer. It must also warn that the land may be near farm operations protected by the Michigan right to farm act. If you know part of the land is a contaminated site, state law requires written notice to the buyer before the transfer. Ask a Michigan real estate attorney what your sale needs. Can I split my Michigan land before I sell it?

Often, but Michigan's Land Division Act limits how many parcels under 40 acres you can create without platting. A parcel that existed on March 31, 1997 can generally make up to 4 parcels from its first 10 acres, plus more for larger tracts. A 2025 law lets local ordinances allow more since March 24, 2026, and raises the first-10-acre count to 10 parcels starting March 24, 2027. Each division needs local approval, and every deed selling unplatted land must say how many division rights pass to the buyer. Ask your local assessor how many divisions your parcel has left. Can I sell my Michigan land if I live in another state?

Yes. You do not need to live in Michigan to sell Michigan land. Liberty Acres buys land anywhere in the US and closes through a title company. We pay back taxes and all closing costs. There are no agents and no commissions.
