Mississippi land selling questions

Is there a transfer tax when I sell land in Mississippi?

No, Mississippi has no state real estate transfer tax. The chancery clerk charges a fee to record the deed. Under the fee schedule in effect through 2027, it is $25 for the first five pages and $1 for each extra page. Ask your chancery clerk or title company about other fees on your sale. Source: Miss. Code 25-7-9(1)(b).

What happens if I don't pay property taxes on my Mississippi land?

Interest and costs are added, and the county can sell the land at a tax sale. Mississippi property taxes are due February 1, and unpaid taxes bear interest of one-half of 1% a month after that. Land with unpaid taxes is sold on the last Monday of August, and some counties also hold a sale on the first Monday of April. The sale adds fees, damages and costs, and land that draws no bid for the full amount is struck off to the state. You then have 2 years to redeem by paying the chancery clerk, so ask the clerk or the tax collector for the amount owed. Source: Miss. Code 27-41-1, 27-41-9, 27-41-55 and 27-41-59.

Can I get my Mississippi land back after a tax sale?

Yes, if you redeem within 2 years after the day of the tax sale. You pay the chancery clerk the taxes, sale costs and 5% damages on the taxes, plus 1.5% interest a month and later costs. The clerk must send the record owner a notice 60 to 180 days before the 2 years end. If no one redeems, the buyer gets a tax deed, or land struck off to the state goes to the Secretary of State for sale. If the land is not redeemed and the bid exceeded taxes and costs, the owner can claim the excess within 2 years after redemption ends. Source: Miss. Code 27-45-3, 27-43-1, 27-45-23 and 27-41-77, and Mississippi Secretary of State, Tax-Forfeited Lands FAQs.

Do I need a disclosure statement to sell vacant land in Mississippi?

Not the state's property condition disclosure statement. Mississippi's disclosure law covers sales of property with a dwelling unit when a licensed real estate broker or salesperson is involved. It specifically excludes transfers of real property on which no dwelling is located. The law also says it does not limit other duties to disclose that exist to avoid fraud or misrepresentation. Ask a Mississippi real estate attorney what your facts require. Source: Miss. Code 89-1-501 and 89-1-513.

Can I sell my 16th section land in Mississippi?

Generally you can sell only your lease, not the land. Sixteenth section land is held in trust for the public schools, and the local school board manages and leases it. The Secretary of State says it cannot be sold, except for industrial development. For leases signed after July 1, 1978, you can assign the lease only if it allows assignment or the school board approves. The board cannot withhold permission arbitrarily, so ask the school district's land manager before you sign a sale contract. Source: Mississippi Secretary of State, 16th Section FAQs, and Miss. Code 29-3-1 and 29-3-69.

Can I sell my Mississippi land if I live in another state?

Yes. Liberty Acres buys land anywhere in the US, so you do not need to live in Mississippi to sell to us. We close through a title company and pay back taxes and all closing costs. There are no agents and no commissions.
