How selling your Oklahoma land works

  1. Tell us about your land. Tell us a little about your land. We'll need the county, state and parcel number.
  2. Get your offer. We research the parcel: access, zoning, taxes and recent sales nearby. Then we send you a written offer.
  3. Sign the purchase agreement. Sign the purchase agreement by email, or we mail it to you. It names the price and the closing company.
  4. Schedule closing. We work with a local closing company to manage the entire closing process at our expense.
  5. Get paid. When the closing paperwork is ready, you sign the deed and receive the funds from the closing company directly.

Oklahoma land selling questions

Is there a transfer tax when I sell land in Oklahoma?

Yes. Oklahoma's documentary stamp tax is 75 cents for each $500 of the price, or fraction of $500, which is about 0.15%. It applies to deeds for land sold when the price, minus any lien that stays on the land, is over $100. The stamps must be on the deed before the county clerk will record it. The county clerk also charges recording fees, so ask the clerk or your title company for the total. Source: 68 O.S. 3201, 3203 and 3204, and 28 O.S. 32.

What happens if I don't pay property taxes on my Oklahoma land?

Interest builds, and after three years the county can sell the land at the June tax resale. Delinquent taxes bear interest of 1.5% a month, up to 100% of the unpaid tax. The treasurer publishes a delinquency notice and mails you one, adding publication and mailing fees. Land with taxes unpaid three years or more is sold to the highest bidder at the resale held each June. The treasurer must also send you notice by certified mail at least 30 days before the resale. Source: 68 O.S. 2913, 3105, 3106, 3125 and 3127.

How long do I have to redeem my Oklahoma land before a tax sale?

You can redeem until the resale auction starts. You pay the county treasurer the delinquent taxes, interest at 1.5% a month and accrued costs. After the resale, the buyer gets a deed with full title, and a suit to set it aside must start within 12 months of recording. If the land sells for more than is owed, the record owner can claim the extra within one year, less any state tax debts. Unclaimed money then goes to the county resale property fund. Do I have to give a disclosure statement when I sell vacant land in Oklahoma?

Generally no, because Oklahoma's disclosure law covers only residential property with one or two dwelling units. The Residential Property Condition Disclosure Act defines property that way, so bare land falls outside it. Fraud rules still apply. Under Oklahoma law, actual fraud includes hiding a known fact or stating something untrue, when done to deceive the buyer or induce the contract. Ask an Oklahoma real estate attorney what your facts require. Source: 60 O.S. 832 and 833, and 15 O.S. 58.

Do my mineral rights transfer when I sell my Oklahoma land?

Generally yes, for any minerals you own, unless the deed reserves them. Oklahoma law gives a fee owner everything permanently beneath the surface, and a deed passes a fee simple unless express words limit it. To keep your mineral rights, the deed needs express words reserving them. An earlier owner may already have severed the minerals, so you may own only the surface. A title company or attorney can check the county records for your parcel. Source: 16 O.S. 29 and 60 O.S. 64.

Can I sell my Oklahoma land if I live in another state?

Yes. You do not need to live in Oklahoma to sell Oklahoma land. Liberty Acres buys land anywhere in the US and closes through a title company. We pay back taxes and all closing costs. There are no agents and no commissions.
