How selling your Oregon land works

  1. Tell us about your land. Tell us a little about your land. We'll need the county, state and parcel number.
  2. Get your offer. We research the parcel: access, zoning, taxes and recent sales nearby. Then we send you a written offer.
  3. Sign the purchase agreement. Sign the purchase agreement by email, or we mail it to you. It names the price and the closing company.
  4. Schedule closing. We work with a local closing company to manage the entire closing process at our expense.
  5. Get paid. When the closing paperwork is ready, you sign the deed and receive the funds from the closing company directly.

Oregon land selling questions

Is there a transfer tax when I sell land in Oregon?

There is no state transfer tax, but Washington County charges a local one. Oregon's constitution bars state and local taxes on real property transfers, except taxes in effect on December 31, 2009. Washington County's tax is $1 per $1,000 of the selling price (0.1%). Recording a deed still carries county fees, including $5 a page and $71 in state-set fees per document. Ask your title company what applies to your parcel. Source: Oregon Constitution Art. IX, Sec. 15, ORS 205.320 and 205.323, and Washington County Transfer Tax page.

What happens if I don't pay property taxes on my Oregon land?

Interest builds, and 3 years after the earliest delinquency the county can foreclose by court judgment. Unpaid taxes bear interest of 1 1/3% a month, which is 16% a year. The judgment starts a redemption period, and if you do not redeem, the land is deeded to the county. The county must send notice at least 1 year before that period ends, so keep your address current with the county. Your county tax collector can give you the exact payoff. Can I get my Oregon land back after a tax foreclosure judgment?

Yes, for 2 years after the judgment, unless your county shortens it. You pay the judgment amount with interest, a 5% penalty and a fee of at least $50. A county ordinance can cut it to 30 days after a hearing if the land suffers waste, or sits unoccupied 6 months and loses value. When the period ends, the land is deeded to the county and all redemption rights end. Since September 26, 2025, a former owner can claim any surplus through the State Treasurer once the county sells, keeps or transfers the land. Do I need a seller disclosure to sell vacant land in Oregon?

Not the state disclosure form, but your deed and sale agreement must carry required land use warnings. Oregon's seller property disclosure statement covers property with one to four dwelling units, condos, timeshares and manufactured homes on owned land. Every deed must include a state statement about lawful lots, approved uses and Measure 49 rights. Sale agreements must also warn that the land may lack fire protection for structures and that farm or forest zones may not allow a home. Ask an Oregon real estate attorney about any known defects. Source: ORS 105.465 and 93.040.

Can a buyer build a house on my Oregon farm or forest land?

It depends on which state dwelling tests your parcel meets. The lot of record test needs the present owner, or close family, to have acquired it before 1985 or inherited it from someone who did. A buyer outside your family cannot use that test, but an approved application can be transferred to any buyer. Most Measure 49 approvals run with the land, but once the approved owner sells, the new owner has 10 years to build. Ask the county planning department which tests apply before you sell. Source: ORS 215.705 and Oregon Laws 2007 ch. 424 sec. 11 (Measure 49, printed as a note in ORS chapter 195).

Can I sell my Oregon land if I live in another state?

Yes. Liberty Acres buys land anywhere in the US, so you do not need to live in Oregon to sell to us. We close through a title company and pay back taxes and all closing costs. There are no agents and no commissions.

Will Oregon withhold tax if I sell my land and live in another state?

Possibly, if the price is over $100,000. The closing agent must then withhold the least of 4% of the price, 8% of the gain taxable in Oregon, or your net proceeds. No withholding is due if you sign a written affirmation that you are unlikely to owe Oregon income tax from the sale. Sales by an estate's personal representative are exempt too. You can claim any amount withheld on your Oregon tax return, so ask a tax advisor about your numbers. Source: ORS 314.258.
