Selling inherited land in Oregon

You can sell inherited land in Oregon once the right person has authority to sign the deed. Whether that takes full probate depends on Oregon's rules, the will, and the size of the estate.

Oregon's small estate rules

In Oregon, the simplified small estate process can be used for real estate in some cases.

The threshold: Simple (small) estate affidavit: no more than $200,000 of the estate is real property and no more than $75,000 is personal property. Both are valued at date of death.

A claiming successor files a simple estate affidavit with the probate clerk, instead of opening a full probate. The 'simple estate' limit is $200,000 in real property.

Law: ORS 114.510, ORS 114.515. Confirm current figures with the probate court.

Steps to sell inherited land in Oregon

  • Find the will, if there is one, and the deed or tax bill showing the parcel.
  • Ask the probate court or an attorney which path applies: full probate, a small estate process, or another filing.
  • Get written proof of who can sign, such as letters from the court. The title company will ask for it.
  • If several heirs inherited the land, agree on the sale and the split in writing. See selling land owned by several heirs.
  • Ask for a cash offer and compare it with a listing. Taxes and loans are paid from the sale at closing.

Taxes when you sell

Inherited land usually gets a stepped-up basis: its value on the date of death. If you sell close to that value, the taxable gain may be small. Our capital gains guide explains it. Ask a CPA about your numbers.

Oregon land at a glance

  • Average farm real estate value: $3,880 per acre (2026, USDA).
  • Average property tax on farmland: about $13.07 per acre per year (2022 Census of Agriculture).
  • Transfer tax: No state deed or transfer tax. Oregon's constitution bars state and local taxes on real property transfers, except taxes in effect on December 31, 2009. Washington County keeps such a tax, at $1 per $1,000 of the selling price (0.1%). County recording fees still apply.
  • Seller disclosure: A vacant lot with no dwelling falls outside Oregon's seller property disclosure statute. The statute covers real property consisting of or improved by one to four dwelling units (plus condos, timeshares and manufactured dwellings on owned land).
