Texas land selling questions

Is there a transfer tax when I sell land in Texas?

No. Texas has no state real estate transfer tax. A 2015 amendment to the Texas Constitution bars new transfer taxes on land sales. No law enacted after January 1, 2016 may impose a transfer tax on a sale of fee simple title to real property. Source: Texas Constitution, Art. 8, Sec. 29.

Do I need a seller's disclosure to sell vacant land in Texas?

Not the standard seller's disclosure, but vacant land has its own notices. The Property Code 5.008 condition notice covers homes with not more than one dwelling unit. It also exempts sales where any dwelling is worth 5% or less of the property's value. For vacant land, Property Code 5.010 requires the sale contract to include a notice about possible rollback taxes. Section 5.011 requires an annexation notice for land outside city limits. Ask your title company or a Texas real estate attorney which notices your sale needs. Source: Texas Property Code Secs. 5.008, 5.010 and 5.011.

Will selling my ag-exempt land in Texas trigger rollback taxes?

Sometimes, depending on which agricultural appraisal the land has. For open-space agricultural land, Tax Code 23.55 bills rollback tax when the land's use changes, for the three years before the change. For land designated for agricultural use, Tax Code 23.46 makes three years of additional taxes plus interest due if the land is sold or diverted. Ask your county appraisal district which appraisal your parcel has. Source: Texas Tax Code Secs. 23.46 and 23.55.

What happens if I don't pay property taxes on my Texas land?

Penalties and interest start, and the taxing unit can sue. A delinquent Texas property tax incurs a 6% penalty for the first month, rising to 12% if still unpaid on July 1. It also accrues 1% interest for each month it stays unpaid. A taxing unit that uses a collection attorney can add a further penalty of up to 20% on taxes still unpaid on July 1. A taxing unit can sue to foreclose its tax lien any time after the tax becomes delinquent. Source: Texas Tax Code Secs. 33.01, 33.07 and 33.41.

Can I get my Texas land back after a tax sale?

Yes, if you redeem it before the deadline. The window is 2 years after the tax sale deed is recorded for a homestead, a mineral interest or land with approved agricultural appraisal. That includes ordinary open-space ag valuation. Other property has 180 days. You repay what the buyer paid, plus a premium. In a 2-year window the premium is 25% in year one and 50% in year two. In a 180-day window it is capped at 25%. Source: Texas Tax Code Sec. 34.21.

Can I sell my Texas land if I live in another state?
